In a civil case if one fails to file an answer to a lawsuit within time limit how must the other party procee?

I file a family lawsuit in Harris County texas and the opposing party, my ex failed to file an answer and is now in default. How do I proceed to default judgment? People who are familiar with the Texas family code please respond. If your ex failed to file an answer you must still go to court on the scheduled date. You will present your argument for a modification, and the judge will consider it with no input from your ex.





That doesn't mean you automatically get whatever you ask for - Family courts are courts of equity, which means they seek an equitable result - which is legal for a fair one.
