You have to prove the fault at the trial. Being cleared doesn't mean anything when it comes to getting sued, only evidence for the outcome.Personal injury civil cases...How can this happen?
You are LYING. It is not possible to become a police officer without knowing anyone can file a civil suit for anything. You were NOT cleared 100%. There is no such thing. The investigation found no reason to charge you with anything. It CAN'T clear you are anything.

I hope he was charged and convicted. That should make things easier for you...
...but the bottom line is this: It can happen because he's entitled to his day in court. Just because your employer and the local police say that it was his fault doesn't mean that he's barred from alleging otherwise in a court proceeding. That answer needs to come from a judge or jury.
He is likely suing you and the entire police department. It is not uncommon for a litigant to name as many possible defendants as he can think of and then, prior to the trial starting, the judge will dismiss defendants in which there is insufficient claims.
He still has the right to file suit - but it probably will get dropped at some point. I'm sure the case will work out to your favor, but that still doesn't impede on his rights, as stupid as his exercising this right for this case is...right?

File a counter affidavit that you are just doing your job and clean of any offense so that you will not be penalized.
