Should the standard of proof in civil cases be raised to reduce the NO of frivolous lawsuits that are filed?

That won't work - you'd still have to file the lawsuit to see if your evidence was up to the burden of proof. So you wouldn't actually do anything to cut the number of frivolous filings.





Besides, the court system is already well equipped to toss out lawsuits that are frivolous.Should the standard of proof in civil cases be raised to reduce the NO of frivolous lawsuits that are filed?
no i do not think so.


not only as one persons notion of frivolous is completely different to anothers but because as it stands the regulations on what evidence can or cannot be submitted to a court are quite strict, they cover not only what the evidence but how the evidence was obtained and whether the opposition was made aware of this evidence besides the standard of evidence has nothing to do with the frivolity of the case it is merely the actual case itself like if a woman sued her hairdresser for one too many centimetres being cut off of her hair.
