Does anyone know what a rape trial is like and can you tell me what to expect. Would it be a civil case?

Or would it be a criminal case? Even though it has been six years that this has happened to my friend can she still have this investigated?Does anyone know what a rape trial is like and can you tell me what to expect. Would it be a civil case?
she could. but it might not get as much attention as a fresh case would. not to mention that it could look suspicious to the jury if the case goes to court. this is especially bad because i have seen rapists get off because they accuse the victim of enjoying it and then deciding later to pursue legal action to achieve either financial or vengeful ends. if your friend wants to have it investigated then she absolutely should. just know where you're going and what you're going to do when you get there, and it will go a long way to winning a case.Does anyone know what a rape trial is like and can you tell me what to expect. Rape is a criminal matter and is dealt with in criminal court. However, there is always a preliminary hearing which deals with the facts as to whether of not, there is sufficient evidence to proceed to trial.


In your friend;s case, was a police report of the incident filed? If not, many questions would be put to her by detectives and in particular, why are you coming forth now, when, you should have done so at the time of the incident.


It is certainly very difficult to lay a charge of rape some six years after the incident. The chance of this charge sticking is highly unlikely unless the offender has been charged previously and convicted or is in the data base of sex offenders.


Another question that your friend would have to have some pretty good answers for, would be the fact of why she is coming forth now, if this is the first time the incident has been reported. The police would wonder if this is a vendetta?


Rape trials are messy at the best of times and, certainly most unpleasant for all concerned.






Rape is definately a criminal case. Yes it can still be investigated but she's gonna have a harder time proving her case with no evidence or witnesses. If the investigator is good, you could always shoot for a confession but its highly unlikely due to the lapse of time.
rape is criminal and really hard to prove .. but that shouldnt shouldnt discourage.. who ever commited the crime better pay for it.. so if you or if you know any1 who has been a victim of rape convince them to press charges.. you can save someone else from going through it
