You can file the papers in the county that you live in to initiate the suit. The Clerk of Court has the packet that you would need to file a small claims suit. The clerks' office is located in the court house of the county that you would like to initiate your suit. I would recommend filing a small claims suit. With a small claims court case you will not need an attorney to initiate the suit. Each state has the the maximum that a small claims case can be which I believe is $5000. I believe there is a small filing fee of around $80 for a small claims case to be filed with the court.

A small claims court case can be settled in front of a judge with you not having to have an expensive attorney. If the person doesn't answer your complaint within a certain amount of days you will receive a default judgment and you will not be required to stand in front of a judge, but you will automatically get a judgment against the debtor. If you win the case, remember that a judgment isn't always going to get your money. The judgment is just a piece of paper stating that you went to court and that she will owe you money. Many judgments are never paid by the debtor.Where do i file the paperwork in a civil case?
